The present conditions of sale are agreed between, on the one hand, the company Élina-WEB, whose head office is located in Rennes, registered under the business identification (SIRET) number 484 538 673 00027, hereinafter referred to as Élina-WEB, and, on the other hand, by any natural person or legal entity wishing to make a purchase through the Internet website Script PAG, hereinafter referred to as "the buyer".

Object

The purpose of the present conditions of sale is to define the contractual relations between Élina-WEB and the buyer and the applicable conditions to any purchase made through the commercial website Script PAG.
The purchase of goods or services through the present website implies full and unconditional acceptance of the present conditions of sale by the buyer.
These conditions of sale shall prevail over any other general or special conditions not expressly agreed upon by Élina-WEB.
Élina-WEB reserves the right to modify these conditions of sale at any time. In this case, the applicable conditions will be the ones in effect at the date of the order by the buyer.

Characteristics of the goods and services provided

The product provided is a website software developed in xhtml/css, php/mysql and javascript/ajax that allows you to create a website.
The associated services include software installation (only for shared and VPS hosting) and software developments at the request of "the buyer", available on quotation.

Prices

The prices indicated on the site Script PAG are expressed in euros and include all taxes.
Élina-WEB reserves the right to modify these prices at any time.
The indicated prices include order processing costs.

Orders

In order to purchase a product or a service, the buyer must:

- Fill in the online purchase order form with his personal details.
- Agree to the general conditions of sale and the conditions of the license agreement.
- Proceed to payment under the agreed conditions.

All data provided and the recorded confirmation shall be deemed proof of the transaction.
The confirmation shall act as the signature and acceptance of the transaction.
The seller shall communicate confirmation of the order validation by email.

Payment methods

Payment is due when you validate your order.

Payments can be made by:

Withdrawal

Refund

No refund shall be made, either total or partial.

Delivery

Automated delivery process, digital products are sent by email after validation and payment of the order.
In case of server failure during the process of sending the email, the delivery can be made manually at the request of "the buyer".

Guarantee

Élina-WEB guarantees that the product Script PAG corresponds to the description made on the site and to the online demo available on the site Script PAG.
Élina-WEB is also liable for any defects resulting from the installation either when it was in charge of carrying it out or when it was performed under its responsibility.
In case of damage or loss of the software, Élina-WEB guarantees to provide a recovery support of the original files.

Liability

Élina-WEB cannot be held liable for damage that arises through improper use, installation or modification(s) of the script made by the buyer.
Élina-WEB cannot be held liable for any inconvenience or damages inherent in using the Internet network, namely in the event of service interruption, for any outside interference, or for the presence of a computer virus.

Intellectual property

All the elements of the site Script PAG are and shall remain as the intellectual and exclusive property of Élina-WEB.
No party is authorised to reproduce, exploit, redistribute nor use in any other way, wholly or partially, elements of the site.

Personal data

The personal data communicated by the customer is necessary to process your order.
In compliance with the stipulations of the article 29 of the law n° 78-17 of January 6th, 1978, referred to as the "Law on Information Technology and Civil Liberties", Élina-WEB guarantees to take all necessary measures to ensure the protection of the communicated information.
In application of the article 36 of the law n° 78-17 of January 6th, 1978, referred to as the "Law on Information Technology and Civil Liberties", the customer has the right to access, modify, rectify and remove his personal information.

Filing - Proof

Élina-WEB will file invoices and quotations on a reliable and sustainable medium to correspond to a faithful and durable copy in compliance with the article 1348 of the Civil code.
The computerised registers of Élina-WEB will be considered by the parties as proof of communications, orders, payments and transactions between parties.

Applicable law

The present contract is subjected to the French law, according to European directives.
In the event of litigation or complaint, the customer will address himself in priority to Élina-WEB to find an amicable arrangement.
In the absence of an amicable arrangement between the parties, any litigation concerning the validity, interpretation and/or execution of the present general conditions of sales will be brought before a court of competent jurisdiction.
