IMPORTANT-READ CAREFULLY : BY USING THE SOFTWARE, THE USER ACKNOWLEDGES HAVING READ THE PRESENT AGREEMENT (EULA), UNDERSTOOD ITS CONTENT, AND AGREED TO BE BOUND BY ITS TERMS AND CONDITIONS WITH NO RESERVES.

The present end user license agreement is a legal agreement between the user, hereinafter referred to as "you" (either an individual or a single entity) and Élina-WEB, and applies to Script PAG classified advertising management software, hereinafter referred to as "the software".

The present agreement shall also govern any update or upgrade provided by Élina-WEB, which would replace and/or supplement the original software, unless such update or upgrade is accompanied by a separate license, in which case the terms of that license would prevail.

DURATION OF AGREEMENT

The present agreement is not limited in time, provided that you respect the terms of the present license and that you grant Élina-WEB the right keep a record of your personal information in to a data storage medium, you will be able to use the software.
When requesting Élina-WEB the removal of your personal information, your rights of use and ownership of the software will terminate automatically. No refund will be issued.

SOFTWARE USE

Rights

The purchase of a license grants you the right to install and use the software on a single domain name.
You can edit and/or improve the software. The terms "improve" and "edit" within the meaning of this agreement signify you can delete/separate/edit/improve the modules of this software and/or add some.
You may copy the software into the local memory or storage device.
You may make archival or back-up copies of the software provided the copy contains all the original Élina-WEB statements and that it is used only for back-up purposes.

Restrictions

You may not sell, rent, redistribute, or create derivative websites based on the software without the prior written consent of Élina-WEB, nor may you associate it with a domain name you do not own.
You are not allowed to change the text " Script PAG created by Élina-WEB". However, you can delete it.
You may not delete or modify the copyright and other proprietary notices contained within the software files.
The software, in whole or in part, must remain confidential and must in no way and under no circumstances be distributed without the prior written consent of Élina-WEB.

Obligations

You must provide the full domain name or IP address of the website on which the developed software is installed.
The installation or use of the software on an additional domain name necessarily implies the purchase of a new license.
You are required to inform us of any changes to your personal information.

RESTRICTIONS ON TRANSFER

This license is personal, and neither the rights granted under the present agreement nor any copy of the software may be sold, assigned, distributed, transferred or sublicensed to any other person without the prior written consent of Élina-WEB.
Any transfer in violation of this section will be null and void, will automatically terminate your right to use or own the software and will lead to prosecutions.

LICENSE ABUSE AND VIOLATION

If any abuse of a license is suspected or found, you agree to surrender your license immediately upon any notification of violation of any of the terms in this EULA and you will not be refunded any money upon surrendering your license.
Élina-WEB will legally safeguard its rights in case of non-compliance with the terms of the present agreement.

UPDATED VERSIONS

Élina-WEB guarantees to provide you with any updates and/or new module(s) for free. However, you are responsible for downloading and installing such updated versions of the software.

GUARANTEE

Élina-WEB provides its clients with the best technical service support, by phone and online, available Monday to Friday from 9.30am to 6pm.
Élina-WEB guarantees that the software will work properly if the following conditions are respected :
- PHP Version 4 or greater
- MYSQL database
- GD Library
- Mod_rewrite
- Activation of automated emails
- File_uploads on ON
- Upload_max_filesize minimum 16M
- Post_max_size superior to upload_max_filesize
- Memory_limit superior to post_max_size
Élina-WEB guarantees the exploitation and operability of the software once the installation is complete.
Élina-WEB guarantees to provide a recovery support of the original files.

LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES SHALL ÉLINA-WEB BE LIABLE TO YOU FOR ANY CONSEQUENTIAL OR SPECIAL INDIRECT DAMAGES, INCIDENTAL OR DERIVED DIRECT, INDIRECT, SPECIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, ANY LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ÉLINA-WEB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
UNDER NO CIRCUMSTANCES SHALL ÉLINA-WEB'S LIABILITY BE ENGAGED IN CASE OF INCORRECT MANIPULATION, MODIFICATION, SOURCE CODE REMOVAL, IN CASE OF BAD HARDWARE OR SOFTWARE CONFIGURATION ON THE CLIENT SIDE OR THE SERVER SIDE AS WELL AS PROBLEMS RELATED TO OBSOLETE HARDWARE OR SOFTWARE.
ÉLINA-WEB DECLINES ALL RESPONSIBILITY FOR THE USE AND RESULTS OBTAINED FROM THE SOFTWARE.

COPYRIGHT

The software is the exclusive property of Élina-WEB.
Élina-WEB retains all copyrights relating to the software. Except as expressly mentioned in the end user license agreement above, you may not copy, reproduce, distribute, rent, or create derivative websites based on the software. All rights not expressly granted are reserved.
Any copy of the software that you are allowed to make under the present agreement terms must include all copyrights and other notices mentioned in the original copy of the software.

SEVERABILITY

In the event that any provision of this EULA is found to be invalid, illegal or unenforceable, a modified provision shall be substituted which carries out the original intent of the Parties to the maximum extent possible, and the validity, legality, and enforceability of any of the remaining provisions shall not in any way be affected or impaired thereby.

APPLICABLE LAW

The present agreement is governed by the French laws and regulations in force. In the event that any provision of this EULA is found to be invalid or unenforceable, it will not affect the validity of the rest of the agreement, which remains valid et enforceable according to its provisions.

SOFTWARE LICENSE

Élina-WEB reserves the right to change or update any part of this agreement, at any time and without prior notice.
